MICROSOFT AUSTRALIA DOUBLE TAKE PROMOTION
TERMS & CONDITIONS:

Instructions on how to claim the Cash Back offer (“Cash Back Offer”) and how to enter the Experience of a Lifetime promotion (“Experience of a Lifetime Promotion”) (collectively, the “Offer”) form part of these terms and conditions. By participating, participants agree to be bound by these terms and conditions.

The Promoter of the Offer is Microsoft Pty Ltd, ACN 002 589 460, 1 Epping Road, North Ryde, Sydney, NSW, 2113, Australia.

The Cash Back Offer and Experience of a Lifetime Promotion is open to Australian and New Zealand residents over the age of 18 years. The Prize winner for the Experience of a Lifetime Promotion may also be required to have a valid driver’s licence. Employees and their immediate families of the Promoter, participating retail outlets, suppliers, Channel Partners (which includes distributors, sub-distributors, re-sellers, retailers and system integrators), associated companies and agencies are not eligible to participate in the Offer.

The Promoter reserves the right to verify the validity of claims and to disqualify any participant who the Promoter agrees either has tampered with the claim process or has submitted a claim that is not in accordance with these terms and conditions of participation.
DETAILS OF HOW TO ENTER:

To be eligible to claim the Cashback Offer Amount and enter the Experience of a Lifetime Promotion:
(a) Purchase any one (1) or more Participating Products from a participating retailer during the Offer Period;
(b) Go to www.microsoft.com.au/hardware/offers;
(c) Complete the entry details including tell us in 25 words or less why you think performance, comfort and design are important in creating PC Hardware. All details in the claim form must be completed.
(d) Click “submit” to submit your details.

The Promoter will send an e-mail confirming receipt of your online redemption and a claim confirmation number. Print out your claim confirmation with your redemption number and send a hardcopy with a legible photocopy of the purchase receipt of the Participating Product by post (“Hardcopy Details”) to PO Box 6066, SILVERWATER, NSW, 1811. Hand written receipts or handwritten delivery dockets will not be accepted..

All Hardcopy Details must be received by the Promoter by no later than 5pm (Sydney time) on the 28th February 2009. The Promoter will not fulfil against any incomplete claim forms. Claims are not allowed on back-ordered products or products that are still awaiting arrival into store or delivery to the customer purchased outside the Offer Period.

Once the Promoter has verified your proof of purchase and checked that the entry is valid, you will be eligible for the Cash Back Offer Amount and enter the Experience of a Lifetime Promotion.
CASH BACK OFFER

The Promoter agrees to provide all eligible participants who submit valid entries with 25% off the Recommended Retail Price (RRP) in Australian dollars (inclusive of GST) (“Cash Back Offer Amount”) on purchases of any one or more genuine, full retail versions of participating Microsoft® Hardware products (refer to www.microsoft.com.au/hardware/offers for a full list of participating Microsoft Hardware products and their RRP’s) (“Participating Products”) from participating retailers in Australia or New Zealand between 1st November 2008 and 31st January 2009 (“Offer Period”) . To qualify for the Offer, you must be the end user of the product/s purchased. Offer not available on System Builder Products, Xbox® Consoles or accessories for Xbox® Consoles.

The Offer is for one Cash Back Offer Amount per genuine Participating Product purchased. There is a maximum of three claims per participant and each claim must be made on a separate on-line claim form. Any costs associated with claiming the Offer, accessing the website and mailing in your claim are the responsibility of the claimant. The Offer is not transferable or exchangeable. The Offer Amount will be paid in Australian Dollars to the participant’s nominated bank account, as provided in their claim form.
EXPERIENCE OF A LIFETIME PRIZE OPTIONS

All valid entries received by 28 February 2009 will also be reviewed by a judging panel appointed by the Promoter in order to determine the winner (one winner) of one of three Experience of a Lifetime prizes. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged according to its originality and creativity.

The most original and creative “25 words or less” entry as judged by the judging panel are able to choose one of three of the following options:

Option 1. Performance Prize. Economy Airflights for two to Sydney, two nights accommodation at a Luxury Inner City Hotel (standard room), rental car (pick up and drop off at airport), Combat Strike Mission and Supercar Drive Day Experience or equivalent activity and fine dining for two for one night at an inner city restaurant selected by the Promoter. Combat Strike Mission includes 30 minute jet flight in a BAC Strikemaster Jet. If you have a heart condition or are over 60, you will need to provide a doctor’s certificate. If the pilot makes a decision that it is unsafe to fly, the activity will be replaced with another activity of similar or greater value. Supercar Drive Day includes morning tea, a 2 course lunch, the opportunity to drive one or more of Ferrari F430 Spider, Bentley Continental GT, BMW M3 (08 model), Porsche 911, and Mercedes SL500 chosen by the Promoter and all fuel for the day. Security bond of $5000 will be paid by Microsoft upfront however must be payable by you in the event of an accident where you are at fault. Drivers must be over 28 years of age and hold a full Australian drivers licence. In the event of extreme weather conditions, the activity will be replaced with another activity of similar or greater value. VALUE: RRP AUD $20,000
If the winner’s point of origin is Sydney, no air travel to or from Sydney Airport will be awarded as part of the prize and no compensation will be paid in lieu.
Option 2. Comfort Prize. 5 nights and 6 days of pampering and indulgence. Included is flights for two (Economy Class) to Queenstown from your city of origin, five nights twin share accommodation (standard room) at the Village Inns, breakfast, dining for two at the ‘Saffron” (or equivalent) dining at ‘The Millbrook’, choice of two spa treatments during your stay , a fully escorted wine and cuisine tour, rental car and transfers. Business Class flights are dependent on availability and may not include all sectors of your travel. Accommodation, dining, spa treatments and tours are subject to availability at the time of booking. VALUE: RRP AUD $20,000
If the winner’s point of origin is Queenstown, no air travel to or from Queenstown Airport will be awarded as part of the prize and no compensation will be paid in lieu.
Option 3. Design Prize. Return airfares for two to Melbourne, overnight luxury accommodation in the heart of Melbourne, two days with the style consultant Angela Stone, dinner & lunch on both days and AUD$5,000 spending money. Your time with Angela Stone will include a salon hair makeover which includes advice on colours and wardrobe and make up solutions. By accepting the prize the winner agrees to allow Angela Stone to direct the hair style, cut and colouring and also agrees to the application of make up. Participants will be required to provide information to any possible food or skin allergies. VALUE: RRP AUD $20,000
If the winner’s point of origin is Melbourne, no air travel to or from Melbourne Airport will be awarded as part of the prize and no compensation will be paid in lieu.

The total maximum prize pool value for the Experience of a Lifetime options is AUD$20,000. The stated prize value is the recommended retail price (inclusive of GST) in Australia as provided by the suppliers of the prizes and is correct as at 23 September, 2008. The Promoter will not be responsible for any change in the value of a prize. The Promoter and its associated agencies accept no responsibility for prizes damaged or lost in transit.

Prizes are not exchangeable, transferable or redeemable for cash. If the Promoter is unable to supply the prize, the Promoter reserves the right to supply another prize of greater or equal value.

Travel arrangements are at the Promoter’s discretion and dependent on the winner’s nearest Australian capital airport. If the Promoter is unable to supply the nominated prize, the Promoter reserves the right to supply another prize of greater or equal value.

Entrants acknowledge that the Experience of a Lifetime prize involves a dangerous activity, including speed. There is a risk that injury or death may result from participating in this part of the competition. By entering the competition the entrant acknowledges and agrees to release the Promoter from responsibility for all liability which may result from the entrant participating in the Experience of a Lifetime prize.

Before one of three Experience of a Lifetime prizes are awarded to the winner, the winner will be required to sign a release in annexure “A” to the terms and conditions to release the Promoter from and indemnify the Promoter against, any and all liability arising from the use of or participation in any part of the competition including participation in the Combat Strike Mission and Supercar Drive Day.

The Experience of a Lifetime prizes are subject to the conditions of any third party supplier and the Promoter and its related bodies corporate are not responsible or liable for any direct or indirect loss suffered by any entrant as a direct or indirect result of the conduct of any third party supplier.

All entries become the property of the Promoter. The Promoter’s decision is final and no correspondence will be entered into. No responsibility is accepted for entries by the Promoter. Entries will be deemed void if stolen, forged, mutilated or tampered with in any way.

The valid entries in the Experience of a Lifetime will be judged at the Promoter’s office at 10am on 20 March 2009 and all reasonable efforts will be made to notify the winner by email and/or phone by 27 March 2009. Within 4 weeks of notification of being the winner the winner is required to provide the Promoter with their preferred prize option from the Experience of a Lifetime prizes, valid driver’s licence and a signed release (see annexure “A”).

In the event that the Experience of a Lifetime prize is not claimed the judges will select an alternate winner to receive the prize.

All meals, beverages, extra activities, additional spending money and all other ancillary costs (including travel insurance, visas) not expressly provided for as part of a prize, are the responsibility of a winner and the winner’s guest. In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

Subject to any applicable law which cannot be excluded, the Promoter and its related bodies corporate shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with the promotion or any prize.

This Offer cannot be used in conjunction with any other offer.

All claims are subject to the Promoter’s verification checks including driver’s licence, as determined by the Promoter in its absolute discretion.

All claims are deemed to be received at the time of receipt into the Promoter’s database and not at the time of transmission by the participant.

Liability for any tax on any benefits provided to customers will be the sole responsibility of the customer.

Subject to all other clauses in these terms, the Cash Back Offer will be paid directly into the nominated Australian bank account as stated on the claim form within 60 days of receipt of the completed claim form and valid proof of purchase. Please note that the bank account details will only be used to transfer money. It is the responsibility of the claimant to provide correct banking details. The Promoter is not responsible for any delays in payment or errors due to factors outside of its reasonable control, including delays or errors in the financial system or errors in the supplied account details. If incorrect banking details are provided by a claimant and a trace is required to locate funds there will be a charge which varies by banking institution which will be payable by the participant.

Any costs associated with participating in this Offer and accessing the website are the responsibility of the participant.

The Promoter assumes no responsibility for, and the participant releases the Promoter from responsibility for, any failure to receive a claim or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the participant’s participation in this Offer or the conduct of the Offer generally or as a direct or indirect result of a participant’s error, any technical problem of any kind including communications or network failure, unauthorised access to, transferring or theft of data, whether caused by the entrant or associated with the equipment or programming used in the conduct of this Offer. If, because of any such problem, this Offer is not able to be conducted as planned and/or the Offer’s administration, security, fairness or integrity are compromised or affected, the Promoter may cancel, terminate, modify or suspend the Offer and/or disqualify any participant involved in interfering or tampering with the conduct of this Offer in any way.

Details from all claims will be collected and used for the purposes of conducting this Offer (which may include disclosure to third parties for the purpose of processing and conducting the Offer). By sending a claim, participants consent to the use of their information as described. Participants may access and/or change their data by following the procedures in the Promoter’s privacy policy which is available at www.microsoft.com/australia/privacy. The Promoter will only use your personal details for marketing purposes outside those described above if you “opt in” to join the mailing list when prompted.
